These Terms of Service govern your use of HVACEXEC.com (the “Site”) and any related communications or recruiting activities you initiate through the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Definitions
“HVACEXEC,” “we,” “us,” means HVACEXEC.com and its affiliated recruiting business, identified on the Site as Alexander Associates Executive Search, LLC.
“Candidate” means any person who submits a resume, applies to a role, or requests recruiting support through the Site.
“Employer” means any company or representative that submits a job order or requests recruiting support through the Site.
“Services” means recruiting-related assistance, including intake, candidate evaluation, introductions, and communications initiated through Site forms or Site contact channels.
“Submission” means any information, resume, file, job order, message, or content you provide through the Site.
Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. If there is a conflict between these Terms and the Privacy Policy regarding data practices, the Privacy Policy controls.
Eligibility
You must be at least 18 years old to use the Site. By using the Site, you represent that you are at least 18 years old and capable of entering into a binding agreement.
Recruiting Services. No Guarantee
HVACEXEC provides recruiting services and recruiting-related information. You understand and agree:
- We do not guarantee interviews, offers, placement, compensation, job availability, or hiring outcomes.
- Employers make independent hiring decisions and set their own criteria, compensation, and employment terms.
- Candidates are responsible for evaluating roles, employers, and employment terms.
- Unless expressly agreed in writing, HVACEXEC does not perform background checks, credential verification, or work authorization verification. Employers remain responsible for compliance and verification requirements.
Candidate Confidentiality And Presentation Approval
Candidate confidentiality is a core part of our process.
We do not share a candidate’s resume or identifying candidate information with an employer without the candidate’s approval.
“Approval” means clear, documented consent to present the candidate for a specific opportunity, such as an email confirmation or other recorded instruction.
We may share non-identifying summaries, such as anonymized experience highlights, when appropriate to evaluate interest and fit.
Your Submissions And Responsibilities
When you provide a Submission, you agree:
- You are providing accurate information to the best of your knowledge.
- You have the right and authority to provide the Submission, including any files you upload.
- You will not provide unlawful, misleading, defamatory, harassing, or infringing content.
- You will not upload malware or harmful code.
Candidates should avoid including sensitive identifiers, such as Social Security numbers, financial account information, or medical information, unless specifically requested through an offline process and necessary for a recruiting step.
Employers represent that job order information is accurate, that they have authority to recruit for the role, and that they will use candidate information only for legitimate hiring evaluation.
Acceptable Use
You agree not to:
- Use the Site to violate any law or regulation.
- Attempt to gain unauthorized access to the Site, accounts, or systems.
- Interfere with Site security or availability, including via scanning, probing, or denial of service activity.
- Use bots, scrapers, or automated tools to access, copy, or harvest data from the Site without written permission.
- Misuse of candidate or employer information, including attempts to collect it for marketing, competitive intelligence, or unrelated solicitation.
We may suspend or block access if we reasonably believe you violated these Terms or created a risk to the Site or to others.
Third-Party Links, Job Boards, And Embedded Content
The Site may include links or embedded content from third parties, including third-party job listing providers. For example, the Site includes an “Additional Career Opportunities” page that displays jobs provided by ZipRecruiter.
Third parties control their content and policies. We are not responsible for third-party sites, availability, content, or practices.
Intellectual Property
The Site, including its text, design, graphics, logos, and content, is owned by HVACEXEC or its licensors and is protected by intellectual property laws.
You may use the Site for personal candidate use or internal business recruiting evaluation. You may not reproduce, distribute, publish, create derivative works from, or commercially exploit Site content without our written permission.
Electronic Communications And Notices
By using the Site or contacting us, you consent to receive communications from us electronically, including by email and phone, using the contact information you provide.
Notices sent to the email address you provide are considered delivered when sent, unless we receive an automated failure message.
Disclaimers
The Site and content are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Recruiting and career content is general information only. It is not legal, financial, or employment advice.
Limitation Of Liability
To the fullest extent permitted by law:
- HVACEXEC will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, or reputational harm.
- HVACEXEC’s total liability for any claim related to the Site or these Terms will not exceed the greater of $100 or the amount you paid to HVACEXEC for Services in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless HVACEXEC from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your Submissions, or your violation of these Terms or third-party rights.
Changes To The Site And These Terms
We may modify or discontinue the Site, or any part of it, at any time.
We may update these Terms from time to time by posting an updated version on this page with a new Effective Date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
Governing Law And Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute not resolved informally will be brought in state or federal courts located in Miami-Dade County, Florida, and you consent to jurisdiction and venue in those courts.
